Written Legal Consultation Request

The process and principles for requesting an attorney's written opinion on a specific legal question under a written fee agreement.

What is a written consultation?

A written consultation is a written legal opinion prepared by an attorney, after examining the information and documents provided, on a question concerning a person's own specific case. The guide articles on this site are general information and contain no assessment specific to any person; a written consultation, by contrast, is prepared for a specific matter and a specific question. A written consultation is not representation in a lawsuit or enforcement proceeding; a separate power-of-attorney relationship must be established for litigation, enforcement or defence.

How does the process work?

  1. Request: The request is submitted briefly through one of the contact channels below. At this stage only a short summary of the subject is sufficient; detailed accounts, documents, or sensitive information such as identity or health data should not be sent.
  2. Acceptance assessment: Under Article 38 of the Attorneys’ Act (Avukatlık Kanunu), an attorney must decline an offer in certain cases (for example, where the attorney has acted for, or given an opinion to, a party with an opposing interest in the same matter). A request may therefore not be accepted in every case.
  3. Written determination of scope and fee: According to Article 163 of the Attorneys’ Act, an attorney–client agreement must cover a specific legal service and an amount or value. The subject of the consultation, the documents to be reviewed, the form of the opinion and the fee are set in writing before work begins.
  4. Payment of the fee: Payment information is provided together with the written fee agreement. No payment is taken through this page.
  5. Review and written opinion: The information and documents provided are reviewed and the opinion is delivered in writing. The time within which the opinion will be delivered is communicated separately when the scope is determined.

Fee

According to Article 164 of the Attorneys’ Act, the attorney’s fee is the amount or value that is the consideration for the attorney’s legal assistance. The fee is set taking into account the scope of the request, the nature of the work and the effort it requires, at no less than the Attorneys’ Minimum Fee Tariff, and is communicated in writing before work begins. No specific amount is advertised on this page. A fee below the attorneys’ minimum fee tariff cannot be agreed (Attorneys’ Act Art. 164/4; Attorneys’ Minimum Fee Tariff Art. 1/3). For legal assistance not listed in the tariff, the fee is determined by reference to similar work in the tariff, taking the nature of the work into account (Tariff Art. 20).

The fee is not contingent on the content or outcome of the opinion; no commitment is made that the opinion will favour the requester.

Scope and limits of the written opinion

  • The opinion is based only on the information and documents provided and on the legislation and case law in force on the date it is prepared; incomplete or incorrect information affects the opinion.
  • The opinion does not mean that a lawsuit, enforcement proceeding, complaint or application has been or will be filed; no step preserving any forfeiture period or limitation period is deemed to have been taken.
  • The opinion is for the person who requested it and covers only the question defined.
  • Preparing a written opinion does not mean that the attorney will also act as counsel in that matter.

Confidentiality and personal data

Under Article 36 of the Attorneys’ Act, an attorney may not disclose matters entrusted to them or learned by reason of their duties. For details on the processing of personal data, see the Privacy Notice (KVKK). At the request stage we recommend that you do not send detailed accounts of events or documents by e-mail or message; this information is requested once the scope has been determined.

How to submit a request

You can submit your request through one of the channels below, stating the subject in only a few sentences. This communication alone does not create an attorney–client relationship or a written consultation agreement; the relationship arises only when a written agreement is made. For details, see the Disclaimer and Important Information page.

Request form

The form sends your request directly to the office; the information submitted is recorded and processed under the Privacy Notice (KVKK). If submission fails, an e-mail draft opens. Please write only a short summary of the subject; do not write detailed accounts of events, documents, ID numbers or sensitive information such as health data.
